Allahabad High Court Orders Probe Into Dual Citizenship Allegations Against Rahul Gandhi

Mumbai: The Lucknow Bench of the Allahabad High Court has directed an inquiry into allegations of dual citizenship against Leader of the Opposition Rahul Gandhi, stating that the claims merit detailed examination.
Hearing the matter on Friday, the court instructed the Uttar Pradesh government to either conduct the investigation itself or refer the case to an appropriate central agency. The bench noted that the seriousness of the allegations required a proper probe to establish the facts.
Petition Challenges Lower Court Decision
The directive came in response to a petition filed by S Vignesh Shishir, a member of the Bharatiya Janata Party (BJP). The petitioner challenged a January 28 order of a special MP/MLA court in Lucknow, which had declined his request to register an FIR against Gandhi.
The lower court had ruled that it did not have the jurisdiction to adjudicate matters concerning citizenship, leading the petitioner to approach the high court for relief.
Claims and Legal Provisions
In his plea, the petitioner sought a detailed investigation and registration of an FIR under multiple laws, including the Bharatiya Nyaya Sanhita (BNS), the Official Secrets Act, the Foreigners Act, and the Passport Act.
He claimed to possess documents and communication purportedly from UK authorities, alleging that Gandhi holds British citizenship. According to the petition, such a status would make him ineligible to contest elections in India or serve as a member of the Lok Sabha.
Case Background
The complaint was initially filed before a special MP/MLA court in Rae Bareli. On December 17, 2025, the high court transferred the case to Lucknow for further proceedings.
After the Lucknow court dismissed the plea, the petitioner moved the high court, which has now called for an inquiry into the matter.
